Abia Guber: Your action is baseless, Appeal Court tells Nwosu … Dismisses case, awards N.1m cost against appellant

The Owerri Division of the Court of Appeal has dismissed yet another action filed by a former PDP Governorship aspirant, Sir F N Nwosu describing the action as baseless and a huge waste of time.
The five man panel of the Court presided by Justice Bala came down heavily on Nwosu using very harsh words to describe his attempt to re-litigate a matter settled by the Supreme Court of Nigeria.
According to the Court, "Governorship is not a do or die affair. The highest Court in the land has settled the Abia Governorship case and it is sad that despite the pronouncement of Supreme Court on the issue, “FN Nwosu seeks to bring up the issue again thereby setting the Court of Appeal on a collision course with the Supreme Court. This Court will not lend itself to such abuse. This matter is hereby dismissed with costs of 100,000 Naira against the appellant".
It will be recalled that Nwosu was a party in the consolidated suit involving Dr. Uche Ogar which the Supreme Court dismissed on May 12, 2017, describing it as a "storm in a tea cup". The appellant’s case is founded on the same issue of tax which the apex Court had settled.
Political analysts say the matter is as good as dead on arrival even if Nwosu proceeds to the Supreme Court to appeal the ruling.

It is however not clear at press time whether Nwosu will approach the apex court in the country on appeal.
